1. Acceptance of Terms

By accessing and using the Loan Certifier platform and SMS messaging services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. SMS Messaging Terms

As part of our loan servicing, we send SMS text messages to your mobile phone. By providing your mobile number and consenting, you agree to the following:

• You will receive loan-related notifications including status updates, document requests, appointment confirmations, and account communications.
• Message frequency varies based on loan activity (transactional messages as needed, typically 1–5 per month per active loan; marketing/educational messages limited to 4 per month).
• Standard message and data rates charged by your mobile carrier may apply.
• Messages are sent from a U.S.-based phone number registered under the A2P 10DLC framework.

3. Direct Opt-In and Consent

You opt in to SMS messaging by providing your mobile number directly to Loan Certifier during the loan application process and explicitly agreeing to receive the notifications described here. The consent checkbox is unchecked by default, so active consent is required. Your consent is given directly to Loan Certifier for the messages described in this campaign, is not a condition of any purchase, and is not bundled with or obscured in any other agreement. Phone numbers are collected directly from you; we do not use purchased lists.

4. No Third-Party or Affiliate Marketing

We do not share, sell, rent, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. All SMS marketing and educational messages are first-party messages sent by Loan Certifier to its own clients and leads. We do not engage in third-party marketing, affiliate marketing, or third-party lead generation with your mobile opt-in data. Your mobile number is not shared with any third party or affiliate for their marketing or promotional purposes.

5. Opt-Out Instructions

You may cancel SMS messaging at any time:

• Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) to any message to unsubscribe from all SMS communications.
• Reply HELP (or INFO) for assistance or support.
• Reply START to resubscribe after opting out.

6. Carriers and Delivery

We use Twilio Inc. as our SMS service provider to deliver messages on our behalf. Twilio receives your mobile number solely to deliver the messages you requested and does not use it for marketing. Messages are delivered through major U.S. wireless carriers. We are not responsible for delays or failures caused by your mobile carrier, signal issues, or carrier-level filtering.

7. Use of Services

You agree to use our services only for lawful purposes. You may not use our SMS services to send unsolicited messages, spam, or content that violates applicable laws.

8. Intellectual Property

All content on the Loan Certifier platform, including text, graphics, logos, and software, is the property of Loan Certifier or its licensors and is protected by intellectual property laws.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. SMS delivery is subject to carrier limitations and is not guaranteed.

10. Limitation of Liability

Loan Certifier shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including SMS messaging. Our total liability shall not exceed the amount you have paid for our services in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless Loan Certifier, its officers, directors, and employees from any claims, damages, or expenses arising from your use of our services or violation of these terms.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Loan Certifier operates. Any disputes shall be resolved in the appropriate courts.

13. Changes to Terms

We may modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
